Kumasi, October 16, 2025 – The lingering shadow over the final farewell for Ghanaian highlife legend Daddy Lumba (real name Charles Kwadwo Fosu) grew darker today as the Kumasi High Court adjourned Akosua Serwaa Fosuh’s high-stakes injunction case to October 28. What was meant to be a showdown over widowhood rites and funeral control has hit a procedural roadblock, thanks to a sharp challenge on Serwaa’s legal standing – or “locus standi” – raised by lawyers for the late musician’s family head, Abusuapanin Kofi Owusu. The delay means Daddy Lumba’s planned December 6th, remains on ice, fueling fan frustration and family feuds that have gripped the nation since his passing on July 26, 2025.

The Spark: A Marriage Under Fire

At the heart of this courtroom clash is a 34-year union tested by time, distance, and allegations of abandonment. Akosua Serwaa, Daddy Lumba’s first wife based in Germany, filed the suit on October 3 at the Kumasi High Court, dragging Abusuapanin Kofi Owusu, his alleged second wife Priscilla Ofori Atta (affectionately known as Odo Broni), and Transitions Funeral Home into the fray.  She claims their 2004 civil marriage under German law – a monogamous vow – makes her the sole surviving spouse, entitled to perform all widowhood rites and lead funeral decisions. Serwaa accuses the family of sidelining her entirely; she only learned of the burial date via social media, and worse, watching Odo Broni step into the “widow” spotlight despite bearing six children with Lumba but never tying the knot legally. 

Her demands are crystal clear: Declare her Lumba’s only wife, bar Odo Broni from posing as widow, halt the funeral until resolved, and restrain the family from body custody without her say-so.  “This case will prove the law protects marriages – a deterrent to mistresses,” her lawyer, William Kusi, declared post-hearing, slamming claims that Odo Broni “suffered” with Lumba as nonsense: “She enjoyed every bit – celebrity life isn’t suffering.” 

The Counterpunch: “You’re Not His Wife”

But the family’s lawyers fired back hard, questioning Serwaa’s right to even sue. They argue she lacks locus standi – basically, no skin in the game – because she’s “not a wife” anymore. According to their narrative, Serwaa returned her “head drink” (a traditional marital symbol) in 2018, effectively dissolving the union customarily.  They paint her as having deserted Lumba years ago, post-German separation, and insist Odo Broni is the recognized widow with deep roots in his life and legacy.  The court, presided over by Justice Dorinda Smith Arthur, must now rule on this threshold issue before touching the meatier claims – a move that sidelined today’s injunction hearing despite Serwaa’s team’s protests that it was “ripe for business.” 

Adding fuel, Otumfuo’s Dadiesoabahene, Nana Kumi Agyare II, weighed in earlier, dooming Serwaa’s bid: “It’s headed for failure – tradition and facts are on the family’s side.”  Media firebrand MC Yaa Yeboah echoed the skepticism: “Why sue a dead man? If bigamy burned you, hit him with it while he breathed.” 

Family Fractures: Sisters Rally, Kids Step Back

The courtroom wasn’t just legalese – it was a family affair. Daddy Lumba’s elder sister, Ernestina Fosu, made a rare, somber appearance in black kente, linking arms with Serwaa and her lawyer amid cheers from supporters like Evangelist Papa Shee.  Ernestina and other siblings have voiced backing for Serwaa, demanding the funeral committee’s dissolution and a probe into Lumba’s death – whispers of shady dealings, like Serwaa and Odo Broni allegedly moving his body post-mortem to Bank Hospital, courtesy of a cousin’s explosive claims.  

Yet, not everyone’s on board. Serwaa and Lumba’s three kids – Calvin (31), Charlyn (24), and Ciara (20) – dropped a bombshell statement disassociating from her suit, pleading for unity: “We stand together as his children from all sides, united in love. Let Dad rest with dignity – no more drama.”   Signed by Charlyn, it calls out “undignified behavior” and prioritizes a befitting send-off over courtroom wars.

Post-adjournment, a suited-up Abusuapanin Kofi Owusu – sparking online buzz with his unexpected whip and coat – softened his stance in a video plea: “Peace, Serwaa. Let’s settle this amicably for Charlie’s sake.”   Veteran broadcaster Kwame Sefa Kayi piled on the peace push: “Lumba doesn’t deserve this circus. Family, unite – give the King his crown.” 

What’s Next for the Highlife Heir?

With the funeral clock ticking and tensions boiling, October 28 looms large. Will the court affirm Serwaa’s locus, greenlighting her widow claim? Or will tradition trump German vows, crowning Odo Broni? One thing’s sure: Daddy Lumba’s spirit – crooning hits like Akosua Serwaa – hangs in the balance, as Ghana watches a legacy unravel in real time.
